Co-Managing Partner Aaron Davis recently shared his legal insight with the Daily Business Review on Florida’s proposed drowning prevention bills. In the wake of more than 100 child drownings in 2025, lawmakers have put forward sweeping legislation designed to strengthen pool safety standards, increase oversight of short-term rentals and expand drowning prevention education across the state.
Aaron noted that the proposed changes could significantly shift how liability is defined in drowning cases. He explained that incidents once labeled as pure accidents may more readily be viewed as negligence or even gross negligence under clearer statutory standards.
“Something that used to be labeled as a pure accident, whether it was negligent or not, will be more easily defined as negligence or gross negligence,” said Aaron. “So, I think there will be more litigation at the outset, but sometimes that’s required in order to understand requirements from a longer-term standpoint.”
