Florida Judge Rules Letters of Protection Are Lawful, Grants Partial Summary Judgment Against State Farm

In a recent Law.com article, Co-Managing Partner Jason Goldman shared his perspective on a Florida judge’s ruling that Letters of Protection are lawful. Jason, who serves as counsel for the plaintiff Complete Care Centers LLC, also weighed in on the court’s decision granting partial summary judgment against State Farm.

He noted that while insurers can investigate claims and ensure legal compliance, they cannot simply refuse to review or pay them. Jason emphasized that the ruling protects injured Floridians, preserves insurers’ safeguards, and could deter similar tactics while clarifying how Florida’s insurance laws work.

“State Farm certainly has a right to ensure that insureds, people who pay for its coverage, comply with the law, and certainly has a right to ensure that healthcare providers are doing the right thing,” Jason said. “But what it doesn’t have the right to do is deny every claim, or not even consider every claim.”
